1.Purpose
This Acceptable Use Policy sets out what you may and may not do with Apex ATS. It applies to every customer, user, trial account, developer account and private label partner, and it forms part of the Terms of Service. If you see something that breaks this policy, tell us at management@apexsales.ai.
2.Use the Service for hiring
Apex ATS is built for recruiting and hiring. You may use it to post jobs, collect and review applications, communicate with applicants about their applications, schedule interviews, manage your hiring team and report on hiring. Using it as a general marketing, lead generation or mass messaging tool is not permitted.
3.Messaging rules
- Message only people who applied to your roles or otherwise gave consent to hear from you about a job.
- Keep messages about the application. No promotions, surveys unrelated to hiring, political content or fundraising.
- Never disable, remove or work around opt-out handling, the opt-out footer or quiet hours.
- Do not use purchased or scraped lists, and do not import contacts who did not apply to you.
- Do not send content that is deceptive, threatening, harassing, sexually explicit, or that discriminates against a protected group.
- Do not send links to phishing, malware or content that misrepresents who you are.
- Comply with the TCPA, CAN-SPAM, CTIA guidelines, carrier registration requirements and the equivalent laws where your applicants live.
4.Fair hiring
You must not use the Service to discriminate on any basis protected by applicable law, or to ask screening questions that are unlawful in your jurisdiction. Scores and rankings are decision aids; you are responsible for every hiring decision and for any notices, bias audits or assessments required where you operate when automated tools are used in hiring.
5.Prohibited conduct
- Breaking the law or infringing anyone's intellectual property, privacy or other rights.
- Uploading malware or content designed to harm systems or people.
- Probing, scanning or testing the vulnerability of the Service without written permission, or interfering with its operation.
- Accessing data that belongs to another customer, or attempting to bypass Row Level Security or role permissions.
- Scraping careers pages, feeds or the application at a rate or in a manner that is not authorized. Public feeds are for your own jobs and for job boards you submit them to.
- Sharing a single login between several people, or selling or transferring an account.
- Reselling, sublicensing or white-labeling the Service without a signed partner agreement.
- Using the Service to build a competing product, or to benchmark it for publication without permission.
- Misrepresenting your identity or affiliation, or impersonating Caspian Solutions or another employer.
6.Applicant content
You are responsible for content applicants submit to your workspace and for how you handle it. Do not store more sensitive information than the role requires, and do not collect government identification numbers, health information or financial account details through screening questions.
7.Enforcement
We may investigate suspected violations and may remove content, suspend messaging, suspend a workspace or terminate an account, depending on severity. Where practical we will notify you and give you a chance to fix the issue. We may report unlawful activity to authorities and cooperate with carriers and providers on messaging abuse.
